These Terms and Conditions ("Terms") govern your use of the platform operated by Duare Services Group ("Company", "we", "us"), doing business as DSG. By accessing or using our home service and taxi booking platform, you agree to be bound by these Terms. If you do not agree, please do not use our services. These Terms are subject to applicable Indian laws including the Consumer Protection Act, 2019, Indian Contract Act, 1872, and Information Technology Act, 2000.
1. Acceptance of Terms
By creating an account, logging in, or placing a booking, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, Refund and Return Policy, and Disclaimer.
2. Eligibility
You must be at least 18 years of age and capable of entering into a legally binding contract to use our services. By using the platform, you represent that you meet these requirements.
3. Service Description
Home Services: We facilitate on-demand home services including AC repair, plumbing, electrical, appliance repair, and other household services. Service availability depends on your location and service provider availability.
Taxi Services: We provide bike and auto taxi booking services. Fares are calculated based on distance using standard rates. Actual fares may vary based on route and traffic.
4. Account and Registration
You must register using a valid Indian mobile number. We use OTP-based verification. You are responsible for maintaining the confidentiality of your account and for all activities under your account.
5. Pricing and Payment
Prices for home services are displayed at the time of booking. Taxi fares are calculated based on distance. All payments are processed through Razorpay, a PCI-DSS compliant payment gateway. By making a payment, you agree to Razorpay's terms. Payment is required before service confirmation. Prices include applicable taxes unless stated otherwise.
6. Payment Gateway
We use Razorpay for payment processing. Your payment data is handled by Razorpay in accordance with RBI guidelines and applicable regulations. We do not store your full card or UPI credentials. For payment-related disputes, refer to our Refund and Return Policy and Razorpay's dispute resolution process.
7. Booking and Cancellation
Bookings are confirmed upon successful payment. You may cancel before a service provider is assigned, subject to our Refund Policy. Cancellation after assignment may attract charges. For taxi bookings, cancellation policies apply as communicated at the time of booking.
8. User Obligations
You agree to: provide accurate information; use the platform only for lawful purposes; not misuse, abuse, or attempt to circumvent the platform; treat service providers with respect; and comply with all applicable laws.
9. Limitation of Liability
To the maximum extent permitted by law, Duare Services Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our aggregate liability for any claim shall not exceed the amount paid by you for the specific service in question. We act as an intermediary connecting you with service providers; we do not guarantee the quality of third-party service delivery beyond our reasonable efforts.
10. Indemnification
You agree to indemnify and hold harmless Duare Services Group, its officers, directors, and employees from any claims, damages, or expenses arising from your misuse of the platform or breach of these Terms.
11. Dispute Resolution
Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in India. For consumer disputes, you may approach the appropriate consumer forum under the Consumer Protection Act, 2019.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
13. Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting on the platform. Your continued use constitutes acceptance. Material changes may be notified via email or in-app notification.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
